arising out of the sale of goods or arising out of
anything done in connection with such a sale,
whether in contract or tort or under warranty
or otherwise, shall not exceed the price of the
product or part on which such liability is based.
9. WARRANTIES
All goods sold are products of the manufacturer
and not of Charles McMurray Co. We shall use
reasonable efforts to obtain from each manu-
facturer (in accordance with the manufacturer's
warranty or customary practice) the repair or
replacement of goods that may prove defective
in workmanship or material. The foregoing shall
constitute the exclusive remedy and repre-
sents our only obligation. Charles McMurray
Co. makes no warranties, expressed or implied,
written or oral relating to any goods beyond
that contained in this paragraph and makes no
implied warranty of merchantability or fitness
for any particular purpose.
10. PRICES
List prices in our catalog are shown for compari-
son purposes only; they are subject to change
and do not represent manufacturer suggested
retail prices. Dealer discount from these prices
is approximately 50% at time of catalog publi-
cation. Prices shown are based on purchases
in full box quantities unless specifically noted
otherwise. Where broken box purchases are
allowed, there is ordinarily an upcharge. For cur-

All prices are exclusive of taxes, customs, du-
ties, tariffs, freight, insurance, and any and all
current and future tax or government charge
applicable to the sale, delivery or shipment
that Charles McMurray Co. is required to pay or
collect and shall be added to the selling price
invoiced to customer.
11. SALES TAX
Sales Tax is currently collected on sales in Cali-
fornia and Nevada. A properly completed Cer-
tificate of Resale must be on file with Charles
McMurray Co. for a customer to be exempt from
Sales Tax.
All sales are expressly conditioned on custom-
er’s agreement to the terms and conditions set
forth above. Any order or statement of intent
to purchase goods, or any direction to proceed
with procurement or shipment of goods, or any
acceptance of or payment for goods shall consti-
tute customer’s agreement to these terms and
conditions. Charles McMurray Co. hereby gives
notice that we object to any additional or differ-
ent terms or conditions set forth in customer’s
purchase order or any other communication. No
additional or different terms shall apply unless
expressly agreed to in writing, signed by an
authorized officer of Charles McMurray Co. No
other representative is authorized to modify
these terms and conditions, or to agree to any
additional or different terms or conditions.
Charles McMurray Co. may unilaterally modify
or amend any portion of these Terms and Condi-
tions of Sale at any time without prior written
notice.
