

TERMS AND CONDITIONS OF SALE
COD fees
are $11 per COD shipment. Backorders
or split orders will incur multiple COD fees. To
avoid COD charges, please consider one of our
electronic payment options.
RefusedOrders:
Thecustomerwillbebilledtwice
the normal freight charges on refused orders. For
prepaid shipments over $500, the actual freight
from the carrier on both the delivery and return
will be billed to the customer.
7. CREDIT REQUESTS/RETURNED GOODS
Merchandise may be returned to Charles Mc-
Murray Co. only with prior approval. Restocking
charges will not apply to returns of inventoried
items that are received in their original packaging
and in new, saleable condition within 60 days of
original shipdate. Aminimum20% restock charge
will be incurred on returns outside the 60 day
window.Additional restockingchargesmayapply.
Please contact our Customer ServiceDepartment
with the order (invoice) number and the reason
for the return.
Defective Items:
Adjustments will be made in
accordance with the manufacturer’s warranty,
which vary by manufacturer. The customer is
responsible for all freight charges associatedwith
tool repairs.
SpecialOrder Items:
Non-stockandspecial order
items may only be returned based on the manu-
facturer’s terms and policies. The credit issued
will be reduced by the manufacturers restock fee
and all freight costs.
Exclusions:
Material cut to length, custom prod-
ucts, items modified to customer specifications
andquantitiesbeyond themanufacturer'snormal
stocking level may not be returned, except for
manufacturer defect. In addition, obsolete, dis-
continued or closeout items may not be returned.
8. RESPONSIBILITY
Charles McMurray Co.'s liability is limited to the
valueof themanufacturers'warranties.Weassume
no liabilityfordamagetopersonorpropertycaused
by merchandise bought from us or through us. All
specifications and engineering information have
been reproduced for our customer's convenience
only;wedonot assume responsibility foraccuracy.
We shall not be liable for any special indirect,
incidental or consequential damages, including
(but not limited to) loss of profits or revenue, loss
of use of the goods or related goods, damage or
injury to the person or property of our customers.
The remedies of our customers set forthhereinare
exclusive and our liability on any claim for loss or
damage arising out of the sale of goods or arising
out of anything done in connection with such a
sale,whether incontract or tort or underwarranty
